Welcome to Poolify.ai (“we,” “our,” or “us”). By creating an account or using our services, you agree to the following Terms & Conditions (“Terms”). Please read carefully.
1. Service Description: Poolify.ai provides AI-generated swimming pool design concepts. These designs are conceptual only, not engineered drawings or guaranteed to be buildable, and are not a substitute for professional construction or permitting guidance. Generated output is for visualization and inspiration only.
2. User Responsibilities: You agree not to upload inappropriate or copyrighted materials you do not own, misuse the service, attempt to reverse-engineer the system, or circumvent credit usage. Accounts violating these rules may be suspended or terminated.
3. Credits & Payments (NO REFUNDS): Poolify.ai uses a credit-based system. Purchases are final and non-refundable, including unused credits, dissatisfaction with AI results, account deletion, model changes, or mistaken purchases. Credits directly fund our AI generation costs.
4. No Guarantee of Output: We cannot guarantee the accuracy, real-world feasibility, or a match to expectations for any AI-generated design. All images are approximations that may contain inaccuracies.
5. Ownership & Licensing: You retain ownership of uploaded photos, and you’re granted a license to use generated images for personal use, with contractors, on social media, and for inspiration. We may request permission to use images in marketing but require explicit consent.
6. Account Data & T&C Consent Logging: By creating an account, you consent to have your acceptance stored, including timestamp, Terms version, and user ID.
7. Limitation of Liability: Poolify.ai is not liable for construction costs, design failures, permit rejections, contractor actions, financial damages, or any outcome from use of AI-generated designs. Use at your own risk.
8. Governing Law: These Terms are governed by the laws of Kansas, United States.

10. License for Marketing
You retain ownership of the photos and content you upload (“User Content”). If you opt in to marketing permission in your account settings, you grant Poolify a non-exclusive, worldwide, royalty-free license to use, reproduce, display, distribute, and create promotional materials from your User Content and generated outputs for Poolify’s marketing, advertising, and promotional activities (including on third-party platforms such as social media). You may revoke this permission at any time in your account settings; revocation applies going forward. For removal requests of content already published, contact hello@poolify.ai
